General Provisions

  1. These regulations define the general conditions, the method of providing services and the sale of a certain range related to the type of business. The Managing Director of the company Chwolka is Marcin Tyczyński, who runs a company under the name Polski Zakład Pogrzebowy Chwolka Tax ID Number/ NIP: 5981473840, Registration Number/REGON: 080227968, hereinafter referred to as the Service Provider.
  2. By using the Website, you confirm that you have read, accepted and agree to the contents of the Terms.

Definitions

Client - a natural person with full legal capacity, a natural person running a business, a legal entity or an organizational unit other than a legal entity, the specific provisions of which confer legal capacity;

Service provider - the company Chwolka , Marcin Tyczyński, ul. Bolesława Chrobrego 12A, 69–220 Ośno Lubuskie.

Company Rules - this document;

Contract - a contract for the sale of services within the meaning of the Civil Code, concluded between the Service Provider and the Customer;

Services - Services that the Service Provider makes available to the Customer

Services

  1. These Company Rules define the rules and the scope of services for the transfer of corpses from abroad and their burial.
  2. Based on a telephone conversation or an e-mail correspondence, the service provider determines the scope and thus the cost estimate of the selected services.
  3. At the customer’s request, the service provider sends a complete and detailed estimate of selected services to the specified e-mail address.
  4. In order to provide the previously agreed services, the customer grants the service provider the aforementioned power of attorney and consent.
  5. The Customer shall provide the Service Provider with the specified documents (if they are available in paper form) in order to speed up the process of transferring the body from abroad, i.e. a birth certificate, a marriage certificate, a divorce decree.
  6. The Service Provider is obliged to inform the Customer of the progress in his case.

Responsibility

  1. The Service Provider shall make every effort to ensure that the Website and the contact facilities offered function uninterruptedly and without disruptions, but shall not be liable for disruptions caused by force majeure.
  2. The service provider guarantees that all information available on the website is up-to-date and transparent, which corresponds to the information provided by telephone and e-mail.
  3. Both the service provider and the customer are obliged to provide only truthful and reliable information.

Payment

  1. The Customer may pay the fee to the bank account previously specified by the Service Provider or, ultimately, to the place where the body of the deceased is handed over.

Withdrawal from the contract

  1. The customer can withdraw from the signed contract before the start of the service entrusted to the company. With the start of the service by the company, the customer withdrawing from the contract undertakes to pay the costs incurred by the company in connection with his order (e.g. procurement of documents, departure of the driver).
  2. Chwolka reserves the right to use emergency solutions in situations beyond its control (e.g. sudden driver illness, vehicle breakdown), about which the customer will be informed immediately. The company does not withdraw from the contract, but points out a possible delay in the provision of services.
  3. Chwolka does not provide its services to third parties.

Complaints

  1. The customer may lodge a complaint in connection with the services provided by the service provider. Complaints may be sent in writing to: Chwolka, Marcin Tyczyński, Bolesława Chrobrego 12A Street, 69–220 Ośno Lubuskie or by e-mail to: chwolka@onet.eu nder the heading “Complaint.”
  2. In the complaint, the customer should indicate his first and last name, the correspondence address, the nature and description of the problem.
  3. The Service Provider undertakes to examine any complaint within 14 days and, if this is not possible, to inform the Customer during this period when the complaint will be processed.
  4. In the event of defects in the complaint, the service provider shall request the customer to supplement it to the extent necessary within 7 days of receipt of the request by the customer.

Website Content

  1. All content of the website, photos, graphics, videos and other materials are the property of the service provider and may not be distributed or used without the written consent of the provider.
  2. We strive to update the website on an ongoing basis and to provide clear and appropriate content. If you notice any defects, typing errors or other errors, please contact us.

Final Provisions

  1. Any disputes between the service provider and the customer will be referred to the competent courts in accordance with the provisions of the Code of Civil Procedure.
  2. In matters not covered by this Regulation, the provisions of the Civil Code, the provisions of the Law on Provision of Electronic Services, the provisions of the Law on Consumer Rights and other relevant provisions of Polish law shall apply.
